Way to many inconstancies - along with the ending depending on one scene where crowds character decides to not only let bale live when he could have choked him to death.. but continue to be caught there after just so the guy can impress his son...? Willing to die for this guys insecurity. Sure he can respect the guy for his integrity and proving he's not a coward.. but no person is going to continue to put there life in jeopardy when given the option of just walking out of that situation and just knocking bales character out or another much more believable scenario. This film was a total mix of serious and realistic western, with absurd western verging on comedy. And I'm not sure the latter was intentional.. didn't work for me.

Not everyone is going to like a film but I think you missed some points. First of all, at the very end we notice Wade calling his horse after the train. He already knows he's going to escape yet one more time. This was one of the keys to how he handled the end game; at no point did he believe he was really risking incarceration.

Nor did he feel much physical risk - for one, in the last sequence, everyone's trying to shoot Evans, not him. And it's established from the beginning that Wade is at the point where he's seeing past being a "logical crook," preferring to spend more time with a woman even if he risks getting caught. He's starting to see his life as meaningless, and even if he takes risks he doesn't care.

In this frame of mind, his respect for Evans actually does mean a lot. Evans was the only person who showed enough balls to stand up a like a man. And it wasn't just for the benefit of the son, if Evans could show he'd get Wade to the train he (or his family) would be paid some considerable money, paid by people that Wade despises.

It wasn’t just so that Bale could impress his son. Bale was getting $1000, and a guarantee that Holland would stay off their property. Crowe’s character knew that.
