Ken, the Witness


I know Ken Joyce got lots of credit and congrats for testifying for the prosecution and telling everyone what really happened but couldn't he have stopped or gotten help when he was watching the brutal gang rape of a woman? He came out the savior but he could have prevented the second rape since he had a front row seat. Instead he ran out of the bar, made a phone call and then disappeared.

The movie somewhat addressed this point with the prosecution's closing statement. Its true that Ken Joyce did nothing when he could have done something helpful, but doing nothing is not the crime defined by the statute. The crime is solicitation, which requires a person actively provoke, solicit, or otherwise support a crime.

Furthermore, Ken was not the only person who did nothing. A bunch of other guys walked in the area and merely stood there. The waitress took one look and just walked away. The bartender and others saw Jodie Foster run away half-naked in fright, yet none sought to investigate or put 2+2 together by realizing the men by the pinballs were rapists.

Granted, their actions don't change Ken's decision, but it lessens the blame on him.

If the bartender heard the screams and had a loaded shotgun, he could have easily called the police first, fired the shotgun in the air, and aimed it at the rapists and said, "Hey you, get the hell off that woman, now, or so help me God the next shot will go through each one of your brains. Do we understand one another, you sick bastards?" That would do it, assuming he isn't outnumbered but he'd get the point across.

Advocating firing a shotgun in a crowded bar is crass stupidity. The risks of injuring or killing someone are enormous.

I have never understood why the US allows civilians to have access to firearms, especially as they often have no training on how to handle them safely.

Well, at first he is too scared to even do that. Eventually, he just gets up the courage to do it, but he does it sort of anonymously, probably because one of the men who rape Sarah is his college buddy. So he wanted to save him as best he could. Remember he also goes to Bob in prison and Bob tries to talk him out of testifying? He almost succeeded, but I think Sarah was able to convince him that Bob was not in the right here.

He should have stood by his friend. Bob was just going along with the peer pressure, caught up in the excitement and a little tipsy. Bob certainly didn't deserve to have his bright future ruined forever because of one drunken bit of tomfoolery. Where I come from you stick by your friends. Nobody likes a snitch, a tattletale. Where I come from rats get poisoned because there's nothing lower than a narc. What Ken did was reprehensible. Stool pigeons have no friends.

Agreed. I hope he didn't.

Sarah did say she wanted to take Bob "home and *beep* his brains out". If I was it that situation I would have inferred she was seriously interested in having sex with me.

Personally I think Ken should have been sharing Bob's cell with him. He watched and did nothing to stop his best mate. I can't believe that is not a crime. It certainly should be, it is morally reprehensible

I think his character was too timid to stand up against he rapists and men who were encouraging the rape. He could have called from the bar when it first started. I believe the manager would have allowed him the use of the phone.

That is what best friends are supposed to, watch their backs and keep them out of trouble. Well that's what mine did for me in a similar situation, and I didn't have to go through Bob's ordeal.

Here is the way I see it. He was a shy skinny boy. If he tried to intervene, these drunk big guys would’ve beaten him up.

And don’t forget that he did call the police. So, it’s unfair to say he did nothing.

He would not have done this in real life. He would not have ratted out his buddy. He would have rationalised it later as just a low class girl from the town gong thru something that she'd accept and forget about. Otherwise he would have been ostracised from his peer group for life.
