He took the bait he was on the rooftop why didn't they get on the walkie-talkie and say he's on the roof they have him trapped up there and just apprehend him instead they get into a shootout where he kills one of the police officers
shareEven funnier is that Harry complains about the stake out cops leading Scorpio slip by "because they were probably talking when they should have been looking"... and yet he does almost the exact same thing later in the film when he takes some time out to check out the nude hippie chicks in the window. He missed a clean shot at Scorpio coming up on the roof because he was ogling a naked girl.
