Donald Trump Is Disqualified From Presidency And Should Be Removed From Colorado Ballot, State Supreme Court Rules

The court stayed its ruling until January 4, subject to an appeal to the U.S. Supreme Court, but their decision foreshadows an election year of twists and turns and fought extensively in the courts. Trump’s campaign said that they would appeal.

The state justices, in a 4-3 decision, concluded that Trump is disqualified under section three of the 14th Amendment. The section prohibits from office those who, after taking an oath to support the Constitution, have “engaged in insurrection or rebellion.” A group of plaintiffs, all state electors eligible to vote in the Republican primary, had challenged Trump’s eligibility, citing his conduct on January 6, 2021.

“We do not reach these conclusions lightly. We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach,” they wrote.

A 6th grader’s ineligibility for the incontrovertible characteristic of age is not remotely analogous. A better analogy would involve a deep red state court deciding by judicial fiat that Kamala Harris cannot run for president in 2028 because her failure as border czar to stop terrorists from entering the southern border amounted to giving aid or comfort to the enemies of the United States; another disqualifier under Sec. 3 of the 14th Amendment. Considering our infantile and retributive form of national politics, this hypothetical is entirely plausible. This Colorado decision is a terrible precedent.

The Senate acquitted Trump of the impeachment charge of insurrection. And Mr. Smith, the special counsel, didn’t charge insurrection in his four-count indictment. Do you think an aggressive prosecutor like Smith would shy from doing so if he thought he could prove it before a jury of American citizens?

The Colorado Supreme Court has ruled a single state trial judge can disqualify a candidate under the 14th Amendment without anyone proving the underlying misconduct to a jury. If a Colorado judge can knock a presidential candidate off its ballot, so can a Texas Judge or a Montana judge, or an Oklahoma judge. You’re naïve if you don’t see this as a precedent that will be misused by those of your disfavored party.

The 14th Amendment was written in 1866 primarily to guarantee the states provide due process to all Americans. If you’re searching for a feckless stretching of logic, look no further than the irony of court of law using the Amendment as a vehicle to deny due process instead.

Correct. As long as Pennsylvania, Michigan, or Wisconsin don't do this then it is really irrelevant.

While I am not a fan of Trump, I do think the people should have the right to decide if they want to vote for him or not.
