Says who? Copyright doesn't dictate canon. Copyright merely indicates right of use. In this case, the creators of this series has the rights to the Lord of the Rings trilogy and the Hobbit - but they did not secure the rights to the Silmarillion or Unfinished Tales. So how do you resolve that if "copyright=canon"? This would render the Silmarillion non-canonical by your logic.
