So, three cars are in an accident and they charge the middle driver? Wouldn't the third driver (the councilman) by the most likely to be charged / blamed for rear-ending the other drivers?

Watch again, he wasn't actually involved in the accident. He was behind it.

The councilman was a few cars back, not the black car that rear-ended the defendant's car. But the fact that he was rear-ended by another car should have bolstered his claim about not seeing the sign, since clearly the driver of the black car didn't see it either.
