Felony trafficking for buying heroin from an undercover?


Right.. It would be a simple possession charge if anything.

That's the only thing that has been bugging me with this show. The teacher wouldn't be in near as much trouble, if any at all, for buying from an undercover. A good lawyer would argue entrapment and get her off

That amount of facial hair would be the biggest giveaway, along with long hair tucked into a hat. Silly.

Agree on both of these. They needed shaves and a haircut. That cop would go nowhere in court. The teacher would have to be dumber than I think she is to believe that.

Once you hit a certain amount of weight (such as over 28 grams or whatever the threshold is in Cally) the law presumes or infers an intent to deliver it even if it were all just for personal use. Usually they call it PWITD (Possession with intent to deliver) even if you never planned to sell any. The intent is inferred from the quantity.

Thank the war on drugs, the same lunacy where a first time offender, even just a mule as opposed to a Tony Montana type, can get up to life for a bag of white powder of sufficient weight. It doesn't take as much weight for PWITD when the controlled substance is heroin as opposed to cocaine or marijuana.

There was no entrapment as she was predisposed to possess the heroin, no one from law enforcement forced it on her or induced her to do something she wasn't already intending on doing.

It's not that black and white in Cali law. A decent defense attorney could have argued it was for personal use and got it knocked down to possession. I'm guessing the teacher was a first time offender as well, which would play into her favor. A white college educated female isn't going to get the book thrown at her on a first time drug offense. She should be smart enough to know this. And if the had enough money to buy an ounce of heroin (28 grams), then she should have enough money for a decent attorney.

I agree in general a first time drug offender with no priors usually receives probation and counseling and if successfully completed then its not even on their record. If they have enough weight for a PWITD charge and no priors then they would prolly reduce it to simple possession and still a sentence of probation, tether, work release or at worse a county jail sentence, no prison. Again I speak in general as I don't live in Cally.

I wish we knew more about the facts and circumstances surrounding J's teachers arrest and what quantity of heroin she actually got caught with as it sounds like they are jamming her for no reason other than she is J's teacher and they want his uncles crew very badly. She may also fear losing her teachers license even with just probation. Moral of the story - don't become a heroin addict.

The public defender in me was almost screaming at her for being a complete moron! Apparently the teacher didn't talk to any attorney at any time. LOL!

We don't know how much she was buying. However, I agree that the charge is bogus. Perhaps it is intentional? The cop is trumping up the charge to scare Alexa into helping her to get to the Codys? What incentive would Alexa have if it was just a minor charge? She would pay a fine, do community service, etc. She is only cooperating because she wants to help herself. I am torn to whether she cares about J. Sometimes it seems like she does but others it only seems like sleeping with him is a means to an end. An end that means she is off scot free.

Does the fact it occurred on or near school property make a difference?

Since 1950 all but two mass shootings happened in gun free zones, notice a pattern?

Did it occur on or near school property? She would no doubt lose her job, though, if she is charged with possession, no matter where the buy took place. She will also lose her job if it becomes known she seduced one of her students.
Hope she has sent out some resumes before either of the above happens.

Regardless, most teaching contracts have a morals clause. Even in a strong union state like California, buying any heroin could get her fired. And I can imagine her not invoking her right to counsel if she were caught.

The police woman stated the amount. It was a large enough quantity to get a distribution charge.

Usually junkies never have more than personal because all the money and dope they get goes up their arm.

J's teacher prolly figured it was cheaper to buy in quantity and also the less transactions on her end the better. I get the feeling she wasn't quite yet a full blown addict, but eventually she would be as heroin is not a social drug as it causes a physical dependency as well as mental.

I never heard an exact amount, my guess would be a quarter ounce give or take.

Yes, that cop is a bully. Don't be surprised if she gets taken down one way or another in Season 2.

I can see the Codys doing something to seriously undermine her attempts to get them, such as planning a fake heist to send her on a wild goose chase or setting her up for something to get leverage over her. She lost her chance to turn J and whatever advantage she may of had by showing them that there's an ongoing effort to catch them. Obviously she can't use Catherine as an informant anyone, nor can she can't prove that Catherine's dead or that any of the Codys had something to do with it, but she can reasonably assume both. The family's too tight-knit to get an undercover cop close to them. Maybe somebody who attends their parties could plant a listening device in the house but the Codys are probably smart enough to sweep for that stuff. Then again, they could fine a bug a carefully control what's said around it to give the cops false clues.

5 grams does not sound like enough for jail time for a first time offender, although I would not know.

I agree that this is a thin plot point. The teacher should be smart enough to consult an attorney on her own, even if she did not consult the defense attorney when she was caught. It is just hard for me to imagine an educated person not actually looking into whether or not she would receive jail time for what she was caught with. Just pay a defense attorney for one hour of time and she could have found all of this out.

This and the Camp Pendleton thread have me thinking that the producers are taking wild guesses on a lot of things to make their story work. Either that or they don't care and figure nobody will notice.

I agree so many things should of gone wrong and the fact no one was around when security detail would find them. You have to suspend disbelief for a lot of these crimes to work.
