Last season, a drunk driver is brought in and the cops order Connie to do a tox screen to prove he was drunk when he smashed into a couple's car, but the guy was critical and needed medical attention first so she refused to do it and got arrested for interfering with the investigation.

shareIt was a pretty lame story line. I can't remember what became of it but I can't imagine any jury convicting, even if a prosecutor had the temerity to bring it to trial.

Thing is, under Illinois law, the hospital is required to do a tox screening. Under Implied Consent, the guy was drunk as ____ and annihilated a couple. It would've taken the hospital minutes to pull the blood tubes and get a urine sample with a catheter. That's it. She absolutely refused, they made a big fuss about the police being evil and she got arrested for it for Obstructing an Investigation. It's not against hospital policy; its state law. How do you think the couple would feel in court when the prosecutor says "yeah, we can't confirm he was drunk, this nurse refused to even test the guy." Thanks nurse.
shareI'm trying to remember the details of that incident. But i remember at the time thinking that it would be easy enough for one doc/nurse to take a couple blood samples while the others were trying to save the patient's life.
A similar thing happened on an episode of House. It was obvious in that case that they whole situation was used as a plot device instead of something that could actually happen.
