A lot of names that are already cleared get used over again...like Michael Westen or Michael Seaver.

Or, just like, well, Kate Warner. Facebook returns about 2 dozen Kate Warners. LinkedIn 100.

All it takes is one of those Kate Warners permission to use the name. It's probably not a Kate Warner that's on Facebook.

You don't need permission to use anyone's name. It just has to be clear that there is no attempt to base the character on a real person.

If anyone of those Kate Warners object, they can't use the name.

Not true! How would I even know about it, if some show or movie was going to use my name for a character? Only after the show aired or the movie came out.

What I could do is, get some shady lawyer and file some crackpot lawsuit and say that the character was based on me. That would be quickly shot down.
