 It's probably just as well that Tandy didn't inadvertently bury him alive. One of the upcoming episodes (3x6, 11/20?) is titled "The Open Ended Nature of Unwitnessed Death" -- I kinda figured it had to be referring to either Mike (which seems unlikely, especially so soon after his departure) or Pat (which would make more sense, given where this season's storyline appears to be going)...

How is that just as well? Personally, I'd much rather bury alive the pissed off crazy man who just tried to murder me rather than leave him alive to try again.

I didn't mean just as well for the Malibu crew, I meant for the sake of the story -- the idea of having Pat still out there as a possible outside threat to the core ensemble (something the show never really dealt with in its first two seasons). 
