shareHoward is smart. He knew that Chuck testifying wasn't going to change anything in a positive way and in fact had a small chance of having a negative impact on Chuck and the firm.
It's like some situations in poker where at the final betting round you have a really good hand but based on what cards are showing there's no point in making a bet because any player with an inferior hand will fold. You'll only get called by a better hand and it won't be offset by the many times you do have the best hand, cause no one will call in those situations.
