Yes, shooting them both is the answer but it is the order in which they are shot/killed that is important; clarify your issue with the plot, i.e. "Why didn't the military guy shoot Marty immediately when the elevator opened?" Obviously there are several answers to that specific question but my point is to be specific when you critique a plot; don't generalize. That is a sloppy and uneducated way of finding a fault in a piece of art.
