Assuming they hadn’t massacred one another as a result of drugs and paranoia. Josh was the one who actually killed her which they had amazing hard evidence. Why didn’t it occur to them that, not even the other guys who had sex with her would be done for her murder cos the whole thing was on the bloody tape.
Plus, did it annoy anyone else that the girls didn’t just agree with the guys until they were on dry land!
One of the guys was Josh's brother, which is why problems arose. Neither of them were going to let Josh get done for murder, and as Josh said, the owner of the boat would be in trouble too. The fourth guy would also get in trouble, since his goading of Josh was also on the tape.
The girls were too hysterical and (as the film showed repeatedly) blindingly stupid to do anything intelligent like agree with the guys until they could escape. Stabbing one of the innocent guys and shooting the owner was their alternate solution.

I don't think there were any 'innocent guys'. Even Josh's brother, the supposed nice guy of the piece, seemed fairly happy to dump the body in the ocean.
I don't remember his name, but the guy who goads Josh into punching the girl would be just as culpable under the law. Most likely they'd both be charged with manslaughter, or criminally negligent homicide.
Personally, I think the entire cast should've been charged with loitering.

I don't think any of them were 'innocent people'. First of all the girls were stupid for getting on the ship with strangers in the first place. Then the fact there was talk of such violent sexual act and the drug taking something bad was going to happen.
For the fact of who would be charged they all had sex while on drugs and I think this is illegal so they would all stand equally guilty for this. Josh did commit two killings both on drugs which i would be classed as murder (i think). However Bluely gave Josh the idea for the act and encouraged josh to try it on lisa so he would be held to account.
At this point only Josh and Bluely would have been charged with anything serious likely both to get assisted murder and manslaughter charges. All of the others might have got cautions for having sex on drugs.
However, it didn't end there, all the boys decided to throw the dead Lisa overboard and although the girls try to stop them the boys over power the girls. All of the boys would be guilty of this, the girls could have phoned 121 to get help.
From this everyone is involved with something with it turning into a fight for the last one left as they fight over the tape. Sean is the only one who dose not kill or threaten anyone and although he did help discard the body I think he was only trying to help, he did try to calm the situation later on as such would probably get away free in court with maybe a caution. However his actions (how ever innocent) did lose him his life over a misunderstanding with Kim. From this I think if the judges in court understand this she would have only got minimum manslaughter charges. Despite this she could not life with her self and and such jumped overboard. Leaving Tammi on her own with Josh who pulls a knife on her, in fear she kills him. With the fact that she known what Josh was capable of I think she would be free. All the others are dead, questions and more questions will be asked when she gets home and she only have a tape that proves she didn't start it all off.
To conclude I think this is a horrible film that i only watched because it is a thriller and i need examples of thrillers in my head for my studies.
