The one thing that makes it obvious Tombstone is a Kingpin surrogate

Is the inexplicable fact that he's good enough to keep up in a fight with Spider-man, despite there being no evidence of any enhancements or powers. He's just a well trained normal human, from the looks of it. It's really suppose his power and intellect that makes him a threat, but somehow he can put Spider-man on the ropes out of nowhere.

It takes me back to old Spider-man comics like Spider-man No More. It was so badass you never questioned it until years later...wait he shouldn't...technically be able to do that.

I'm certain if Spider-man was fighting to cripple or kill, or actually went all out the fight wouldn't last two seconds. Tombstone would be a bloody smear on the pavement.
