from a legal perspective, the www.en.wikipedia.org/wiki/Duty_to_rescue is clearly incumbent on the baby who is convictable of failure to help a person in danger and therefore should be prosecuted and put to death (if not worse)!
It was strategically planned. The motif is clear (as posted below): "Obviously the baby had issues with his or her parents! The little one saw a chance to get rid of them for good not to mention scoring a yacht in the process."
I mean, it probably thought it could get away with it, pleading age-related mental incapacity, difficult childhood or just sail off to some foreign country, but no, it should have thought it through better ... it will be caught, as can be seen in the sequel: Open Water 3 - Killer Baby vs. Kindergarten Cop

PS: I have heard Matt Damon is trying to get the role as the baby on the run (as an unofficial extension of the Bourne series. And Arnie has already announced he will slip back into his shoes as Kindergarten Cop (given his private miss-steps have made it hard for him to get any better role).

And I gotta say... as one who has no experience with yachts... the thought of lowering the ladder would never have occurred to me before watching this movie. Or I would have assumed there was a ladder in place all the time.
Then again, I would have stayed on deck grabbing some rays... so I would have let them back up. Girls first of course...

Speaking of the baby, personally I think it was dumb and irresponsible of the mother to even bring her baby on board where everyone was drinking and having a good time, enjoying a party atmosphere....certainly not a place for a small baby or child!! There is such thing as a babysitter or grandma!! lol
