Why the missing episodes?

First off IMDB has every episode incorrectly numbered. So that makes this difficult. So I get A&E on demand. Therefor we get all the episodes. However there are (so far that I've seen) Season 1 Episode 5 and Season 2 Episode 5 that are COMPLETELY unavailable!!! I can't even buy them. (Not that I would!) But my question is why?

There were a few episodes that A&E stopped showing due to lawsuits against them. California, Here Dog Comes was one, and This Dog Can Hunt was another. What happened in the first case? I don't know. But, in the second one, a motel owner where a fugitive supposedly was got into a fistfight with Leland, and ended up losing a lot of business after the episode aired.
