Marvel was interested in doing a comic series but HBO wouldn't let them.

Marvel is still interested, by the way. There was an interview with Daniel Knauf fairly recently (see below) where he mentioned that if he ever did anything with HBO again, he'd make the comic rights to Carnivale part of the contract.

There wad a lawsuit filled against hbo and Daniel Knauf for plagiarism. I'm surprised this isn't referenced in the trivia section of this page. I read the lawsuit and it seemed to have a lot of merit.

Yeah I read that and the question is if whether or not he can prove that A.) the was working on such a novel before Knauf was working on his and B.) Knauf had actually read it.

Yeah it's pretty hard to prove someone read something. Even harder to prove who had an idea first.
I forgot the outcome of the trial. I think they settled.
But if it was plagiarism, it explains why HBO won't have anything to do with it and will not release rights to anyone.

Knauf won with prejudice. The fact that the screenplay for the pilot episode was up on his website for years before it got picked up probably had something to do with it.

The judge dismissed it with prejudice. It all had to do with a writers' group both belonged to.

In the commentary for the pilot he said he wrote it in, I think, 1992 and he really didn't expect it to ever be made. That said I don't know about the book but whos to say some of the stuff from the later episodes didn't came from the book. I'm guessing that he was probably sued because he had become somewhat famous and had a fairly popular show. My understanding was that HBO canceled it because of the cost not the popularity and this is the first I heard of him being sued but there have been plenty of cases of people trying to sue someone who has something popular just so the person suing can make money off of the other person's work, but like I said I don't know anything about the other person or their book so I can't say for sure one way or the other.

HBO owns everything - the characters, the storyline, everything - and they won't release it. Dan Knauf has tried - had Marvel ( I think) all lined up, but HBO wouldn't let go.
