Disclaimer at end of film

"The characters and events depicted in this photoplay are fictitious. Any similarity to actual persons, living or dead, is purely coincidental."

Huh? This movie was based on real-life gangster John Rooney and his son, Connor. I'd call that similar! I don't get the standard disclaimer at the end.

my guess is that was said since they probably did not have permission to use specific names of real people etc so they did that for legal reasons?

Not to mention the references to Capone by name and profession

The real Rooney was actually called John Patrick Looney so technically there was no infringement there. Plus from I know about the Looney's, Connor Looney was killed in the 1920s not the winter of 1931, though it was regarding a dispute between his father and a former leuitenant. However that associate was not called Michael Sullivan, his fictitious. Therefore everything is only very loosely based or inspired by real life. The only real people were Frank Nitti and Al Capone (who was never seen in the released cut of the film).
