well as for premise, there are many movies that have the same premise. but it's not until we see how they exacute the premise then we could call it Plagiarism.
Ex. the premise is A man rents a family for the hoildays movie one- he holds an audition and picks certain people. One girl gets sick so she sends her sister to fill in for her. movie two- he bargines with his neighbors. movie three- he gets people off the internet and one of them turns out to be black.
Actually, the John Grisham book is called "Skipping Christmas" not Surviving Christmas. Its a good book but it has nothing to do with renting a family for Christmas.
first of all this isnt the first movie that has been adapted from a foreign film. take solaris for example there is one with the same name that is so much better and that is a foreign film then they remade it with George Clooney whichwas a horrible movie. any way there are tons of movies adaptated from foreign films
Plagiarism is when you steal somebody's WRITING. An IDEA is an idea, and cannot be copyrighted. So, if you get an idea about renting a family for Christmas, and casually mention it to your Aunt Tilly and she runs home and pounds out a screenplay over the weekend, sells it, and it goes into production, you are screwed. If you want to STEAL an idea and do your thing to it, no one can say anything. If, however, you actually steal PAGES from someone's screenplay, or actual DETAILS of scenes and dialogue, then MAYBE you can get in trouble. That's why you get so many variations on A CHRISTMAS CAROL and IT'S A WONDERFUL LIFE; those ideas are up for grabs. Look at the recent David Spade comedy - it's all about renting a family - just not for Christmas.
Actually, you can't copyright an idea. Well, maybe it isn't copywriting, but you can register it with the WGA. I do that with all my script ideas because otherwise it is up for grabs. The samrt thing to do is to just not tell anyone anything about the movie unless they are a studio exec or you want to invite them to the premier!!!

It's called a remake. It's not the same thing as what they're talking about. They're talking about something like 30 Going on 13 and Big (with Tom Hanks). Same idea put to another situation, thus being stolen. It's different when you tell everyone "Hey I'm remaking this movie, it's already been made." Plus I think Solaris with George Clooney is golden. Never seen the original nor read the book, but still I like it.
It does sound like the one movie with Eric McCormack and Roma Downey - exactly what I was thinking.
And "Skipping Christmas" is indeed a John GRISHAM book that is having an entirely different movie coming out to be based on it. Sounds pretty funny judging by the cast. In fact, according to the IMDB news the MPAA made them change the title from "Skipping Christmas" to "Skipping the Holidays" to avoid exactly this type of confusion between the two movies.

Bosses at the Motion Picture Association Of America have ruled the title is too similar to Ben Affleck's new Dreamworks film Surviving Christmas, which is also released this November. Revolution partner Joe Roth has also been denied the name John Grisham's Skipping Christmas, according to trade paper Daily Variety.
close your fat yap. First of all I don't watch TV and hardly any movies. I have many ideas, some real bad and some I like. I can say oh this is my idea... xxxxxx and then you would say... YOU STOLE IT. The world is small in many ways yet also large. Creative people suffer from always being told the stole their idea when in fact oftentimes all they do is think... and have do many ideas that they can't even keep up with them.
