I don't know when prison phones started recording conversations between inmates and visitors, but once Callahan found out that Elle got Brooke's alibi, wouldn't it have been a simple matter to subpoena the taped conversation between the two when Brooke confessed to getting liposuction on the day her husband was shot? And furthermore, wouldn't she have been examined before being put in jail on the murder charge? I don't recall liposuction being a small surgery. Wouldn't her incisions be noticed? How would that have been missed?
It probably would have been easy to get the recording but I figured he'd rather try to get Elle to tell them before doing that cause even if he could have gotten them, it still probably would have taken at least two or three days, whereas if Elle had just told them, it would have taken like 2 minutes.
But I think you're right. I imagine it would have been pretty easy for him to be able to get a recording of the conversation.
Just based on her alibi and the evidence Elle was able to figure out in the 5 minutes she was question Chutney, you'd think they would have been able to figure out it couldn't have been Brooke that killed Windham, even if they hadn't been able to figure out it was Chutney.

I thought the fact that Brooke didn't NEED Hayworth's money as she was a wealthy mogul on her own with her successful fitness empire should have been a glaring red flag to Callahan's firm that Brooke was not the killer.

If Chutney having a trust and the ex-wife not needing the money cause of reasons I can't remember throw suspicion off of them why wouldn't Brooke have suspicion thrown off of her as well since she was pretty wealthy on her own, without Hayworth? At least if we're assuming money is the motivating factor in the murder.
