Fatal Flaw (Spoilers)


I enjoyed this movie, but there’s one fatal flaw that irks me, forgive me if it has been discussed before on these threads. Nick (DeNiro’s character) is obviously the utmost cautious and professional burglar. When Jack realizes that he does not have the scepter in his possession, he threatens Nick that he will rat him out to the authorities. Nick reminds Jack that it is he (Jack) the police are after and there is nothing to tie himself to the crime. But I remember when Jack pulled the gun on Nick to take the scepter from him, he told Nick to take off his ski mask, which Nick threw to the floor, leaving hair and sweat behind as perfect DNA samples for the police. When the guards enter shooting, Nick takes off with no attempt to retrieve the cap. Obviously, Nick anticipated that Jack might double-cross him, but how could he be so careless to leave behind evidence that would implicate himself?

I think Nick did grab the mask.

That's right, first thing he grabs when the alarm goes off is the mask.
Because even if Nick isn't in the systerm for DNA, he could always be ID'ed
by the cameras.

Yeah by the cameras that never caught a glimpse of his face.

Well if you paid closer attention, you'd see that he did take his mask. You can clearly even see him wearing the mask as he descends through the tunnel. In fact, he has it on for the most part of his escape through the tunnels. How you can miss so many of these scenes is beyond me.

I wondered the same thing BUT unless you have that person's DNA it does you kno good. It is possible that he had another mask to use but as someone pointed out he grabbed it before leaving (I don't recall seeing it but I'll take their word). Besides, Jack is going to be out of the country in a few hours and he has already sold the piece.

Like one of those master heists you read about in Europe occasionally, where some group of thieves pull off some super art heist. Most of the time you never hear about them being captured.

The police know there was a second guy. When Jack gets caught he'd have no reason to protect Nick and would at least attempt to give him up, whether as payback or to cut a deal. There's likely to be some bit of evidence that either connects Nick to him or actually being there the night of the robbery. I just don't think he's free and clear as it suggests at the end of the movie.

It's just a movie obviously so that doesn't bother me, but if we're going to treat it like a realistic situation I think Nick is at least going to become a suspect at some point.

Worse than that, Jack is going to come after Nick with a baseball bat (at the least). Nick wants to have a quiet little life in retirement with his gal. But he is going to have to look over his shoulder forever.

The usual movie response to this plot point is "There's a sealed letter with information on who you are. If anything happens to me, that letter goes to the police." But in this case, the police already know who Jack is. So Nick has nothing on Jack and Jack has already shown he is a hothead who is ready to use weapons to make his point.

I don't see a comfortable retirement for Nick.

He picks up the mask and runs away with it. Plus this was in 2001 so I'm not where DNA testing was at that point, and remember the floor was covered in water from the explosion.
