It did not qualify under either of the four criteria of a Death Penalty Eligible Capital Offense in the state of Texas:

he only crime for which the death penalty can be assessed is capital murder. The right to plead insanity was not granted until 1991, meaning beforehand, mentally unstable peoples accused of murder were put to death.[13]
