Man suing ex wife for health insurance card
I've been catching up with the shows from this past week, and one which stuck out to me is the man who is still supporting his 17 year old daughter, and gave a photo copy of his health insurance card to his ex-wife to cover medical emergencies for the 17 year old, when needed.
First, the man explained the card gave access to his Health Care Savings Account (HCSA) which Judge Judy said she 'never heard of before', and cast a wary eye on him. These have been around for quite a few years now, it's an option in your health plan (if you get benefits from your employer) in which your employer will deduct money from your paycheck each week, and put it into a 'health savings account'. This is very popular with people who opt for a high deductible plan, and this way they have money saved to pay off expensive co-pays, 'surprise bills', or other medical expenses.
The man gave the ex wife access to this savings plan only for their 17 year old. It's like a debit card, and she has to know the 'PIN' number to actually use it.
So at one point, his 28 year old daughter asked him what the PIN was, via text. He was at work, he responded quickly - didn't ask questions, and gave the pin. Turns out, the 28 year old was not asking for her 17 year old sister, but for herself - to pay her own $600 medical bill.
So he's suing the wife since it was solely in her possession, and she gave the daughter the card (or access to the card), and scammed the dad and the system.
Judge Judy says - no, you're suing the wrong person. Sue your daughter. HUH?
IF the man gave the ex-wife possession of this card for only the 17 year old to use, and somehow it gets out of her possession (she was unclear on whether she gave this to the 28 year old, or it was just taken from her), isn't she responsible for what goes on the card??? As he said, he can be charged with insurance fraud, and lose his health benefits.
I'm not sure what JJ was thinking on this one.
