when thora birch goes topless in American Beauty, it is not illegal. Her parents provided permission and were onset when filming of that scene took place, also child labor representatives were also present.
with the right rules followed, minors are allowed to be nude on film. if rules are not followed, then yes, its illegal and defined as child pornography.
you shouldnt make such sweeping generalizations without having the proper facts.

she was 16 at the most, but 17 when it came out in selected theaters. she was 15 during the audition.
Thats right, Drew was 16 when this was filmed. The scene with Drew and Tom Skerrit having sex on the car is really Drew. Drew approached the directer (Katt Shea) and said that "If you do not film me nude then I'm going to quit. No body double can be used it has to be me!" Shea listened to Drew and it was her used for the film!
