This takes place a year after the first one, no? If Marv & Harry bugulraized that many homes I doubt they would be out after a year - unless its explained in the movie, which I haven't seen in many years.

shareYes, it could have been regarded as a plot hole if the film writers had not informed the audience that the Wet Bandits had escaped from jail. I also wonder whether Marley informed the police that they had tried inflicting physical harm on Kevin - such revelations would have presumably added a number of years to their initial sentence for the burglaries.
They broke out of prison. This time around however, they likely got a harsher sentence. Since they encountered Kevin TWICE and threatened to shoot Kevin.
sharePlus them being both convicted felons they're not allowed to own a firearm and it's a mandatory minimum of 5 years if you're a felon in possession of a firearm.
