What was the purpose of the sting operation near the beginning where Penn pretends to shoot two men who were also cops? Who was the guy Penn was with?

Although he was Jackie's friend years ago Frankie is far less likely to trust him and probably wouldn't take Jackie's word for anything as he sees him as a drunken embarrassment.
When they do a bit of research and find out that he has apparently killed two guys who were trying to rip him off in a drug deal gone bad he is instantly accepted as a criminal, as well as having the necessary skills and lack of morality.
