1. He wasn't insulting the fat guy like Jerry, George, and Elaine, so he wasn't being malicious.
2. He captured the crime on camera, which could lead to the carjacker's arrest.
I mean, it's ridiculous that any of them were arrested, because the guy had a gun, and as the cop explains the law requires people to help if it's reasonable. How is it reasonable for an unarmed person to try to stop a criminal with a gun?
But since Kramer was recording the carjacking, he actually was helping the victim, so he wasn't violating that law after all.
Kramer had been in the government's crosshairs ever since he said he no longer wanted mail. They were waiting to pounce.

IMO the writers made a mess of the whole scenario. As you can imagine this has come up from time to time. Larry David said, on the Season 9 DVD featurette "The Last Lap," that the germ of the idea for the Finale came from a law he heard about in France. Clearly, the philosophical and legal concepts of a duty to rescue someone to whom you have no special relationship vary around the world. This is a very interesting area of philosophy and law; however, the Finale does not portray an accurate representation of U.S. law, as well not representing foreign laws which as you suspect involve scenarios where there is no potential danger to the bystander.
Even if they had altered it to make it that the gang had to notify police (rather then render aid) it still wouldn't have made sense as it all happened so fast, I don't think they had cell phones on them, and a policeman came on the scene immediately afterward (who, it seems, was more interested in arresting the gang than going after the robber.)
I think most here at the forum would agree that Seinfeld is among the greatest sitcoms to ever air on television. Unfortunately, it also had one of the worst series finales unloaded on the public. Oh well, as Jerry himself would say: "That's a shame."
I don't see the same rants about how unrealistic it was to have someone literally riding a missile in Dr. Strangelove. You exaggerate things in a satire to ridiculous levels. In case people didn't notice, this show did that from time to time. It was Jerry and Larry's last FU to the PC nature of society and they went to ridicurous levels of absurdity to do it.
Can we please let this one go now? It's been 18 years. We get it. Some people didn't like it. It's not very realistic. Neither is the second spitter story. Neither is Jerry caring more about a massage than sex. Neither does B.O. stick around for weeks after you've showered several times. If realistic was a dealbreaker for anyone, they shouldn't have made it beyond season 4. Or even to season 4.
I saw the finale first run, and I actually thought Kramer would have walked away scott free because he did the taping. As George implied, Kramer always has dumb luck. But it shows you how much I know...
