The judge said 84 month at first but it was reduced somehow. I didn't understand probably because English isn't my first language. So I read other posts looking for an answer and got further confused. Could someone help me out, please? :)
Thank you. :) I thought the sentence was reduced from seven years because of the look of Parnell's faith (even though it was already too short for what he had done). I didn't get what the judge was saying. Does anyone have a script?
i finally figured it out somehow sometime, but i think i forgot it again ^^ but i'll try..
so back in that time in California a person couldn't get the the maximum sentence for the same "case" two times or something..
That means, that Parnell got 84 months = 7 years for Timmy, which was the maximum sentence for kidnapping 2nd degree.
Steven's case kinda merged into Timmys (b/c he had both of them "at the same time" - at least for two weeks) so it was the same crime.. 2nd degree kidnapping.
So Parnell got 84 months for kidnapping Steven AGAIN, but 64 months of the sentence from the TIMMY TRIAL had to be "considered" (i forgot why exactly 64 months, but it was the "best" they could do for Steven at this point), which means 20 months "left" for what he did to Steven.
So actually Parnell got 104 months, that would be 8 years and 7 months, normally prisoners serve like 2/3 of their sentence, 8,6 years * 2/3 = 5,16 years before they get probation.
So I guess my calculation is legit.
Parnell went to prison on March, 1st 1980 (that time is considered when serving the real sentence.. in my country it's called "Untersuchungshaft"). He got out April 1985. That makes 5 years and 1 month.
I think the only way for them to give Parnell a longer sentence back then (laws have changed now in the US) would've been to identify Steve's kidnapping as 1st degree kidnapping (he was harmed while living with Parnell) or do a seperate trial for the sexual molestations.
