I've often wondered if "all that bullsh!t", as Agent Mosley called it, that they were going to charge Jimmy Serano with (conspiracy to obstruct justice, interstate racketeering, conspiracy to commit murder, kidnapping The Duke, etc.) would hold up in a court of law. I'm no lawyer but I have a feeling that in real life his lawyer would have had him out of jail in time for breakfast.
Well once they investigate all those gun-toting goons they caught, they'd find out they were connected with Serrano and doing a job for him, so that makes the murder conspiracy charge stick. Don't know if they'd need an actual statement or court testimony from the Duke, but just the fact he was seen there in possession of Serrano and his guys Darvo and Joey by a huge amount of federal witnesses most likely ensures the kidnapping charge.

I agree with the other posters. The grin on the agent's face was way too big to think there was a possibility he was going to lose in court...as was Serrano's resignated demeanor. We can also surmise that at least one of the wiseguy's would turn states evidence in exchange for witness protection.

I don't know law but it sounds believable to me. The main thing is it sounds cool when De Niro recites the list.
