Is this a goof?

In Sledge in Toyland (#2.11) Sledge and Doreau visit the victim's apartment and Sledge says he's proud that Doreau is finally breaking the rules by entering the apartment without a warrant. A crime was committed there, so they don't NEED a warrant, do they? not to mention they are the investigating detectives assigned to that case.

If a murder is committed in your apartment, for example, the police have the right to search around during the initial immediate investigation. Once they pack up and leave, they need permission or a warrant to re-enter if they want to conduct another search. In the case of this episode, since the tenant was dead it's possible that the landlord could give them permission. But it's stated that they broke in so they didn't ask permission. What is kind of a goof is when they come back to her apartment, the searching that they do is what they should have done during the initial investigation. So it's just bad police work.
