The reason the footage was not destroyed is because this was treated in the manner of a murder investigation from day one (albeit it very bungled). Then the footage was used as evidence during the trial, thus making it a matter of public record. Anyone requesting it could look at it.
I thought there were exceptions to that rule. For example, they don't allow anyone who requests it to look at child porn that was used in a trial, do they?
