The torture of Scorpio


After Harry tortures Scorpio in Kezar Stadium, the next scene goes to the recovery of the girls body, now please correct me if I am wrong but seeing that her body was recovered, Scorpio clearly gave Harry the location of her now dead body, only the kidnapper would know the location and since her body was recovered, why was Scorpio allowed to go free ?

Judge Bannerman stated that the hunting rifle could not be used as evidence in a court of law regarding the rooftop shootings and yet Harry forced Scorpio to give up Ann Mary Deacon's location which blatantly identifies Scorpio as her kidnapper so just how much information is the D.A's office NOT allowed to act upon ?

Although we do not see it, I'm pretty sure it was the WAY that Harry got the information that guaranteed Scorpio's freedom. And it also added to the police-procedure-vs.-vigilantism motif that was the major undercurrent of the film.

Meh, Criminal rights and the law in general are confusing monuments of complicated crap, You're not the only one who doesn't get it...

The confession and the gun had to be excluded as evidence because 1. The confession was obtained without a lawyer being present and the gun was found during a warrantless search of Scorpios room.

But couldn't they have at least gotten him on assault and attempted murder 2 counts ( Callahan, Chico) of attempted murder? Even if he did have the ski mask on Callahan could identify him by clothes and voice. I'm sure the blood on his switchblade would be found I. The park and that would match Scorpios blood type.

In the real world the police would find a way to hold Scorpio (they're not stupid), and Harry would have either found a way to torture Scorpio without leaving evidence or simply denying it ever occurred in the first place (he's not stupid either, or shouldn't be since he made inspector).
