The scene in the DA's office-logic gap.
The scene where Harry is told by the DA that they plan to release Scorpio is ridiculous.
Despite the fact that Harry did not have a search warrant, and that he tortured a suspect, there is no way Scorpio would have been released. Scorpio's actions before his arrest would have given the DA enough cause to detain him.
It seemed to have escaped everyone's attention that he tried to kill Harry and his partner with a machine gun. His fingerprints would have been all over the gun. He uses the same weapon to batter Harry and shoot Gonzales. A half decent prosecutor would have been able to make an assault and or attempted murder case against Scorpio. What about poor old Officer Collins who "never knew what hit him."? Isn't that called murder? The political/media pressure on the Mayor would inevitably filter its way down to the DA,who have to find anything to hang around Scorpio's neck.
