From what I understand, he is suing the McCain/Palin ticket for the use of the word, Maverick as he does not support the ideals of the Republican Ticket.

What you are referring to was a satirical piece. It wasn't even started by Garner.
I'm quite sure James Garner know the difference between the word 'maverick' and the fictional characters named 'Maverick'.
