When the first shot was fired while Rupert and Brandon were tussling for the gun (as you can see in this picture: http://imdb.to/1TVZ5M1), how come the gunfire didn't alert the other people living the apartment? Unless there were nobody living downstairs or in the whole apartment (which seems weird because it was atleast a eight storey apartment), this is a huge flaw.
shareWell, maybe their neighbors were out. Rupert opened the window before firing that second shot. The window was closed when the first shot was fired.

Wasn't that (firing 3 or 4 random gunshots into the air in a dense urban environment) incredibly bad judgement on the part of Rupert? Those bullets gotta land somewhere. What if their ultimate destination was into some random stranger's head?
I know it serves the movie's need for 'drama', but in the real world, Rupert, please just keep pointing the gun at the two suspects and telephone the police. You're welcome.

There is one minor flaw with that scene. The one fellow calls the garage for his car before Rupert even shows up to get his "forgotten" cigarette case. Now the car would have been driven out of the garage within minutes, so wouldn't the person driving the vehicle be calling the house to let them know that the car is waiting for them? They talked to Rupert for about 15 minutes, so a follow-up phone call on the car should have taken place during that time.
Very minor detail, though.

It would have made more sense to have had one of them go to the phone in order to make the call to the garage man, and just as he's about to pick up the phone, Rupert phones.

I figured it took place in New York City and no one would care if there were gunshots because they hear them so often

However it's also possible that it was noticed by the neighbors and that allowed the police to get close enough for the sirens at the end of the movie to make even better sense. I.E. The neighbors called for the cops after the first shot and they were already on their way. So when the three shots got fired they were close enough to be heard that soon.

ONE gunshot could be mistaken or misheard for anything.
