Smoking at a gas station?

At about 8 minutes into the movie, Roy Earle, stops his car at a gas station and asks for some water and 10 gallons of gas. He then lights a cigarette, right in front of the car, while talking to the gas station man. Surely, even back in the '40s, it was forbidden to smoke when gas/petrol was being pumped?

Are you going to tell Roy "Mad Dog" Earle to put out his cigarette?

You can't go wrong drowning politicians Henry. The Black Swan (1942)
