Smith never went through the legal process of being appointed by the Supreme Court or Congress. He was never confirmed by the senate.
Smith was appointed ILLEGALLY by the Biden administration just to Prosecute President Trump.
His appointment is not valid under the constitution's appointments clause.
Smith falsified documents and got caught and admitted to it in court.
Smith tampered with evidence and brought incriminating props to the mar-a-lago raid.
Smith has a proven track record of bringing bogus cases against Republican candidates.

If he insisted to continue charging Trump, I would say he could be someone just trying to do the right thing.
