Its not and Kellogs is going to either lose or settle. Since its a class action, people can sign up and probably get a check for a few dollars each.

I remember when I was a kid and would see all the cereal commercials where the cereal had all these strawberries and bananas in it and then I would be disappointed when I opened the box and none of that was in there.
